Stain non-pressure treated?

The HOA is correct. Exposed wood needs to be pressure treated or a wood like cedar that is naturally resistant.

Try warm water with some dish soapy added. Wash with a very soft scrub brush of push broom. Rinse with water when done.

Splintering deck - correct process?

It will not eliminate the cracks, bit will remove the splinters. Cracks are nor mail exterior wood. Sand from 60-80 grit, not finer.
